Purchase Contract/ Health Guarantee

 

“Buyer & Purchaser” are used interchangeably to indicate the individual listed as the buyer on the signature page of this document. From this point forward Evereve Kennels will be listed and referred to as “Seller”.
 

This puppy is in good health, to the best of our knowledge, at the time of sale. It has been given age-appropriate vaccines to prevent known canine illnesses as well as put on a proper worming schedule. Buyers will receive a copy of vaccinations for their records at the time of purchase. Worming treatments have been given regularly. Buyer must have the puppy examined by a licensed veterinarian of his or her choice within 48 hours of picking up the puppy and provide proof to Seller within one week of purchase.

The puppy is guaranteed for 48 hours from the date and time of purchase against infectious diseases such as Parvo*, Corona, or Distemper as long as all the terms of this contract have been followed. (*The puppy has some immunity from the Parvo disease from the mother and vaccination. Puppies are not fully covered until their third round of vaccinations. Because Parvo is such a contagious disease, and the puppy can be exposed to it in any public place or even on your property without you even knowing it, you must be cautious about where you allow your puppy to go or who touches your puppy until it is completely safe from the Parvo virus.

 

Health guarantee excludes internal and external parasites, fertility issues, eye color changes, Ears up or testicles dropped, and communicable diseases. We do not guarantee size or coat color/type. We make no warranty that you will be able to show or breed this puppy/dog. Should a serious health problem be diagnosed during the buyer's initial veterinarian check-up, the seller must be informed by phone within 48 hours of the diagnosis. We may require a second opinion from a licensed veterinarian and will require a copy of the documentation. The Puppy will only be replaced if both duly qualified veterinarians agree on a serious defect. We guarantee a replacement puppy equal to or of lesser value to the buyer but the original puppy must be returned to the seller at the buyer's expense.

 

The seller guarantees against life-threatening congenital defects (heart, liver, or kidney) for the first year of the puppy’s life and will replace the puppy with the next puppy of equal to or lesser value if there are any congenital defects found as long as the terms of this contract are followed. Should your veterinarian find a life-threatening defect, he/she must provide a detailed statement signed by the vet within 24 hours to Evereve Kennels. Seller reserves the right to require a second veterinarian to examine the dog at the Buyers expense to confirm the diagnosis. In the unlikely event that the dog has been diagnosed with a life-threatening congenital defect, Buyer will be responsible for returning the dog to the seller at Buyers expense and receive a puppy of equal or lesser value. If no puppies are currently available the seller will have up to 12 Months to replace the puppy for the buyer.

 

In the unlikely event of this puppy’s death in the first 12 months, due to a congenital defect, a statement from a veterinarian confirming such an event and the cause is required before the Seller will take any action. If the cause is unknown, an autopsy is required at the Buyers expense. Purchaser understands that it may take up to 12 months for there to be a replacement puppy available if Breeder is actively breeding. Breeder has the right to rest the Dams and Purchaser understands there are only so many planned breedings each year.

If no puppy is available at that time seller will have 12 months to replace the puppy with another puppy. No refunds will be given nor will seller be responsible for any veterinarian bills.

 

Buyer agrees to provide proper housing, quality nutrition, regular vaccinations, wormings, and veterinary care as needed. Any evidence of neglect or abuse will void the health guarantee of this contract.

 

Breeder assumes no responsibility for this puppy after leaving the premises regarding medical expenses or otherwise incurred by the Buyer on behalf of this puppy.

 

Deposits

 

A minimum deposit of $200 is required (unless other arrangements have been made) to hold a puppy for you until it is weaned. Registration paperwork will be given to the Buyer at the time of pick-up when the puppy is paid in full. Deposits are non-refundable/transferable should you change your mind or if you decide not to pay for and/or pick up your puppy at the agreed-upon date.

 

The total purchase price of the puppy is non-refundable and no replacement or exchanges will be made once a puppy has been purchased, except as noted in this

document. There will be no refunds due to incompatibility, allergies, change of mind, and/or landlord disputes. The buyer has one week to pick the puppy up after we notify them that the pup is ready to go unless other arrangements have been made. If not picked up within that time, the pup will be put back up for sale and the buyer will lose their deposit. The purchaser agrees that under NO circumstances will this puppy be sold, leased, or given to any pet shop, large breeder, research laboratory, or similar facility.

 

Terms & Conditions

 

Please fill out completely and sign below if in full agreement with the above said terms and conditions. Purchaser understands it is their responsibility to print and keep a paper copy of this contract for their records. This contract is final and represents all guarantees, agreements, and terms of the sale of this puppy between seller and buyer. Any deviation from the above contract will be cause for voiding the health guarantee of the contract. The breeder is available to answer questions or give advice throughout the lifetime of the puppy.
